As a litigator, it is not something new to go to court and argue your case on what the position of law should be for a certain matter or issue.
Today however was different.
I was fortunate to have been put to assist on a Court of Appeal case involving an important question of law on the interpretation of certain statutes and subsidiary legislation and the powers it conferred on the relevant authority. After almost a year of hard work, it finally culminated in the hearing before the Court of Appeal panel today.
The case was one of the first to he heard. After hearing the submissions by both parties and deliberations, the Court decided in our favour! Needless to say I was extremely happy! :)
All the stress of running around preparing submissions, authorities (we had a 5-inch high bundle of cases to support our arguments), additional bundle of documents and doing additional research to the very last minute was all worth it!
This case, unlike other wins, could possibly be a landmark decision on the issue. One of my colleagues who assisted in the research commented that the best part of being a litigator is that you can play a part in developing / changing the law. I agree! :)
